Successful Lakeland FL Short Sale Closing - A Relieved Seller


Successful Lakeland FL Short Sale ClosingI'm happy to report another Lakeland FL Short Sale that closed successfully today with the help of Florida Real Estate Attorney Richard Zaretsky and his outstanding team.  I was contacted December 2010 by the property owner who just got laid off.  He found me through the many articles I have written on Active Rain about Lakeland FL Short Sales. We talked lengthy about his situation when I visited his home.  It was clear to me that his home was in need of repairs and certainly needed some cleaning to show. The owner expressed to me that he needed to move out of the state so he can look for a job and be with his family.  So, I told him that we would list the home after he cleaned it up and moved out but before he consider a move, he should contact a real estate attorney and a tax advisor.

The home seen quite the traffic despite the work it needed to be done. Certainly, a cash buyer would benefit from this great location.  A buyer was found and a cash offer was accepted.  During the negotiations, my client became anxious as most owners are when trying to sell their Lakeland FL home as a short sale because of all the stories about buyers walking from the sale.  I always kept the buyer's agent in the loop and updated her frequently about the transaction and this is what she wrote today in an email to me, "It was also a pleasure to work with you I wish all agents  were as diligent and profesional as you."

Approved Short Sale in Lakeland FLThe contract was accepted by the mortgage servicer for Century 21 Mortgage and Bank of America, an approval letter was issued.  The closing took place today and when I talked to my client, he was very relieved.  While BOA granted a deficiency waiver, the mortgage servicer for Century 21 Mortgage did not. Although this property was sold without a waiver of deficiency, there could be a chance the lender may not pursue the borrower for the balance that is due. I advised him to seek legal advice when he is contacted by the servicer.
